Cookies and EULA

Por favor lee estos Términos de Servicio ("Términos") cuidadosamente antes de usar la aplicación móvil Finnwise (la "App"), operada por Inversa Financiera Digital S.A. de C.V. ("Finnwise", "nosotros"). Al usar la App, aceptas quedar obligado por estos Términos.

Uso y restricciones

• La App está pensada para uso personal y no debe usarse para actividades ilegales.
• Eres responsable de la exactitud y legalidad de la información que ingreses en la App.
• Debes cumplir con las leyes y regulaciones aplicables al usar la App.

Cuentas y seguridad

Si creas una cuenta de Finnwise, eres responsable de mantener la confidencialidad de tus credenciales y de todas las actividades realizadas desde tu cuenta. Debes notificarnos si detectas accesos no autorizados.

Almacenamiento y sincronización de datos

Finnwise ofrece sincronización en la nube para que puedas acceder a tus datos desde múltiples dispositivos. Para ello usamos Firebase (servicios de Google) como infraestructura de backend y sincronización. Dependiendo de la plataforma y configuración, cierta información también puede almacenarse localmente en tu dispositivo.

Asistente de inteligencia artificial

La App incluye un Asistente que utiliza inteligencia artificial de un tercero (Google Gemini, a través de Google Cloud Vertex AI) para ayudarte a registrar y entender tus finanzas. Su uso es opcional y requiere tu consentimiento explícito: el Asistente no envía ninguna información hasta que aceptas, y puedes seguir usando el resto de la App sin activarlo. Al usar el Asistente, ciertos datos (tus mensajes y parte de tu información financiera) se procesan mediante dicho servicio. El detalle de qué datos se envían, cómo y para qué se describe en nuestra Política de Privacidad.

Servicios de suscripción

Finnwise puede ofrecer planes gratuitos y planes de pago (suscripción) con funcionalidades adicionales. Las funcionalidades disponibles pueden variar según la plataforma, región y versión de la App.

Precios, facturación y renovación

• Si contratas una suscripción, ésta puede renovarse automáticamente hasta que la canceles.
• Puedes cancelar en cualquier momento desde la tienda de apps correspondiente; el servicio normalmente se mantiene hasta el fin del período de facturación vigente.
• La facturación, reembolsos, cambios de plan y condiciones específicas se rigen por las políticas de Apple App Store y/o Google Play.

Términos de tiendas

La App está sujeta a los términos estándar de las tiendas donde se distribuya (Apple App Store y/o Google Play). Al usar la App, aceptas también dichos términos aplicables.

Limitación de responsabilidad

En la máxima medida permitida por la ley, Finnwise no será responsable por daños indirectos, incidentales, consecuenciales, especiales o punitivos derivados del uso o la imposibilidad de uso de la App. La App no constituye asesoría financiera, fiscal o legal.

Ley aplicable y jurisdicción

Estos Términos se rigen por las leyes de México. Cualquier controversia relacionada con la App o estos Términos se someterá a los tribunales competentes de México, salvo disposición imperativa en contrario.

Please read these Terms of Service ("Terms") carefully before using the Finnwise mobile application (the "App"), operated by Inversa Financiera Digital S.A. de C.V. ("Finnwise", "we"). By using the App, you agree to be bound by these Terms.

Use and restrictions

• The App is intended for personal use and must not be used for unlawful activities.
• You are responsible for the accuracy and legality of the information you enter into the App.
• You must comply with all applicable laws and regulations while using the App.

Accounts and security

If you create a Finnwise account, you are responsible for keeping your credentials confidential and for all activity under your account. Please notify us if you suspect unauthorized access.

Data storage and synchronization

Finnwise may offer cloud synchronization so you can access your data across devices. For this purpose we use Firebase (Google services) as our backend and sync infrastructure. Depending on your platform and settings, some information may also be stored locally on your device.

Artificial intelligence Assistant

The App includes an Assistant that uses third-party artificial intelligence (Google Gemini, through Google Cloud Vertex AI) to help you record and understand your finances. Its use is optional and requires your explicit consent: the Assistant does not send any information until you agree, and you can continue using the rest of the App without enabling it. When you use the Assistant, certain data (your messages and part of your financial information) is processed through that service. Details on what data is sent, how, and for what purpose are described in our Privacy Policy.

Subscription services

Finnwise may offer free plans and paid subscription plans with additional features. Available features may vary by platform, region, and App version.

Pricing, billing, and renewal

• If you purchase a subscription, it may auto-renew until you cancel it.
• You can cancel at any time through the relevant app store; service typically continues until the end of the current billing period.
• Billing, refunds, upgrades/downgrades, and store-specific rules are governed by Apple App Store and/or Google Play policies.

App store terms

The App is subject to the standard terms of the app stores where it is distributed (Apple App Store and/or Google Play). By using the App, you also agree to those applicable terms.

Limitation of liability

To the maximum extent permitted by law, Finnwise will not be liable for indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of (or inability to use) the App. The App does not provide financial, tax, or legal advice.

Governing law and jurisdiction

These Terms are governed by the laws of Mexico. Any dispute relating to the App or these Terms will be submitted to the competent courts of Mexico, unless mandatory law provides otherwise.

Esta Política de Privacidad ("Política") explica cómo Finnwise (Inversa Financiera Digital S.A. de C.V.) recopila, usa y protege información personal de los usuarios de la App.

Información que recopilamos

• Datos de cuenta: correo electrónico, nombre (si lo proporcionas) y credenciales de autenticación.
• Datos financieros ingresados por ti: transacciones (fecha, descripción, monto, categoría), saldos, métodos de pago, metas de ahorro, presupuestos, listas y etiquetas.
• Mensajes del Asistente de IA: el texto que escribes o dictas al asistente dentro de la App.
• Datos técnicos: información del dispositivo, sistema operativo e identificadores técnicos (por ejemplo, dirección IP) para seguridad, prevención de fraude y funcionamiento.

Firebase (sincronización y backend)

Si usas funciones de cuenta y sincronización, tus datos pueden almacenarse y sincronizarse mediante Firebase (servicios de Google). El tratamiento por parte de Google se rige por sus propias políticas y términos.

Uso de inteligencia artificial de terceros (Asistente)

Finnwise ofrece un Asistente que utiliza inteligencia artificial para ayudarte a registrar y entender tus finanzas. Este asistente funciona con un servicio de IA proporcionado por un tercero: Google Gemini, operado por Google a través de Google Cloud (Vertex AI).

Qué datos se envían. Cuando usas el Asistente, enviamos a Google Gemini únicamente lo necesario para generar una respuesta:

• Los mensajes que escribes o dictas al asistente.
• Información financiera de tu cuenta: tus transacciones, saldos, categorías, métodos de pago y metas de ahorro.

Qué datos NO se envían. No enviamos a Google tu nombre, tu correo electrónico, tu contraseña ni tus credenciales de inicio de sesión.

Cómo se recopilan estos datos. La información financiera proviene de los datos que tú mismo registras dentro de la App. Los mensajes provienen del texto que escribes o dictas en la pantalla del asistente.

Para qué se usan. Estos datos se procesan con el único fin de interpretar tu solicitud y generar respuestas, sugerencias y propuestas de transacciones dentro de la App. No se utilizan para publicidad ni se venden a terceros.

Tu consentimiento. Antes de enviar cualquier dato al servicio de IA, la App te solicita tu consentimiento explícito. El Asistente no envía ninguna información hasta que aceptas. Puedes optar por no usar el Asistente y seguir utilizando el resto de la App con normalidad.

Protección por parte del tercero. Google trata los datos enviados conforme a sus propios términos y políticas de privacidad, que ofrecen un nivel de protección equivalente al descrito en esta política. Puedes consultar cómo Google maneja estos datos en cloud.google.com/terms/data-processing-addendum y policies.google.com/privacy.

Captura automática desde notificaciones (solo Android, función opcional). Si activas la captura automática de transacciones, el texto de las notificaciones de tus apps bancarias también se envía a Google Gemini para identificar el importe, la categoría y el método de pago. Esta función es opcional y requiere que la actives manualmente.

Cómo usamos tu información

• Proveer y mantener las funciones principales de la App.
• Autenticar tu cuenta y proteger la seguridad.
• Habilitar sincronización entre dispositivos (si aplica).
• Atender soporte y responder consultas.
• Mejorar la App (por ejemplo, detectar errores y prevenir abuso).

Seguridad

Usamos medidas técnicas y organizativas para proteger tu información, incluyendo comunicaciones cifradas (HTTPS/TLS) y controles de acceso. Ningún sistema es 100% seguro; por ello, también es importante que mantengas seguras tus credenciales.

Retención

Conservamos información solo durante el tiempo necesario para prestar el servicio, cumplir obligaciones legales o resolver disputas. Puedes solicitar eliminación de tu cuenta y datos (sujeto a obligaciones legales aplicables).

Tus derechos

Puedes solicitar acceso, corrección, exportación o eliminación de tus datos escribiendo a contacto@finnwiseapp.com.

Usuarios del EEE (GDPR)

Si te encuentras en el Espacio Económico Europeo, podrías tener derechos adicionales bajo GDPR (p. ej., portabilidad, restricción u objeción). Contáctanos para ejercerlos.

Privacidad de menores

La App no está dirigida a menores de 13 años (o la edad mínima requerida en tu país). No recopilamos intencionalmente información personal de menores.

This Privacy Policy ("Policy") explains how Finnwise (Inversa Financiera Digital S.A. de C.V.) collects, uses, and protects personal information from users of the App.

Information we collect

• Account data: email address, name (if provided), and authentication credentials.
• User-entered financial data: transactions (date, description, amount, category), balances, payment methods, savings goals, budgets, lists, and tags.
• AI Assistant messages: the text you type or dictate to the assistant inside the App.
• Technical data: device/OS information and technical identifiers (e.g., IP address) for security, fraud prevention, and functionality.

Firebase (backend and sync)

If you use account and sync features, your data may be stored and synchronized using Firebase (Google services). Google’s processing is governed by its own policies and terms.

Use of third-party artificial intelligence (Assistant)

Finnwise offers an Assistant that uses artificial intelligence to help you record and understand your finances. This assistant runs on an AI service provided by a third party: Google Gemini, operated by Google through Google Cloud (Vertex AI).

What data is sent. When you use the Assistant, we send to Google Gemini only what is necessary to generate a response:

• The messages you type or dictate to the assistant.
• Financial information from your account: your transactions, balances, categories, payment methods, and savings goals.

What data is NOT sent. We do not send Google your name, your email address, your password, or your login credentials.

How this data is collected. The financial information comes from the data you record yourself inside the App. The messages come from the text you type or dictate on the assistant screen.

What it is used for. This data is processed for the sole purpose of interpreting your request and generating responses, suggestions, and proposed transactions within the App. It is not used for advertising and is not sold to third parties.

Your consent. Before sending any data to the AI service, the App asks for your explicit consent. The Assistant does not send any information until you agree. You may choose not to use the Assistant and continue using the rest of the App normally.

Protection by the third party. Google processes the data sent in accordance with its own terms and privacy policies, which offer a level of protection equivalent to that described in this policy. You can review how Google handles this data at cloud.google.com/terms/data-processing-addendum and policies.google.com/privacy.

Automatic capture from notifications (Android only, optional feature). If you enable automatic transaction capture, the text of your banking apps' notifications is also sent to Google Gemini to identify the amount, category, and payment method. This feature is optional and requires you to enable it manually.

How we use your information

• Provide and maintain the core functionality of the App.
• Authenticate your account and keep it secure.
• Enable cross-device synchronization (if applicable).
• Provide support and respond to inquiries.
• Improve the App (e.g., troubleshoot issues, prevent abuse).

Security

We implement technical and organizational measures to protect your information, including encrypted communications (HTTPS/TLS) and access controls. No system is perfectly secure; keeping your credentials safe is also important.

Retention

We retain information only as long as needed to provide the service, comply with legal obligations, or resolve disputes. You may request deletion of your account and data (subject to applicable legal requirements).

Your choices and rights

You can request access, correction, export, or deletion by emailing contacto@finnwiseapp.com.

EEA users (GDPR)

If you are located in the European Economic Area, you may have additional GDPR rights (e.g., portability, restriction, objection). Contact us to exercise them.

Children’s privacy

The App is not intended for children under 13 (or the minimum age required in your country). We do not knowingly collect personal information from children.

Este Acuerdo de Licencia de Usuario Final ("EULA") es un acuerdo legal entre tú ("Usuario") y Finnwise (Inversa Financiera Digital S.A. de C.V.) que regula el uso de la App.

Uso permitido

La App se concede bajo licencia para uso personal y no comercial, sujeto a estos términos y a las leyes aplicables. No debes usar la App con fines ilegales.

Responsabilidades de la cuenta

Si creas una cuenta para sincronización (Firebase), eres responsable de mantener seguras tus credenciales, actualizar información de cuenta y reportar accesos no autorizados.

Propiedad intelectual

La App, sus marcas, diseños y funcionalidades pertenecen a Finnwise o a sus licenciantes y están protegidos por las leyes de propiedad intelectual. Este EULA no te transfiere derechos de propiedad sobre la App.

Limitación de responsabilidad

En la máxima medida permitida por la ley, Finnwise no será responsable por daños indirectos o consecuenciales derivados del uso de la App. Finnwise no garantiza que la App esté libre de errores o interrupciones.

Resolución de disputas

Cualquier disputa relacionada con este EULA o el uso de la App se intentará resolver primero mediante negociación de buena fe. Si no se resuelve, se someterá a los tribunales competentes en México, salvo disposición imperativa en contrario.

This End User License Agreement ("EULA") is a legal agreement between you (the "User") and Finnwise (Inversa Financiera Digital S.A. de C.V.) governing your use of the App.

Permitted use

The App is licensed (not sold) for personal, non-commercial use, subject to these terms and applicable law. You must not use the App for unlawful purposes.

Account responsibilities

If you create an account for synchronization (Firebase), you are responsible for keeping your credentials secure, maintaining accurate account information, and reporting unauthorized access.

Intellectual property

The App, including its trademarks, design, and functionality, is owned by Finnwise or its licensors and is protected by intellectual property laws. This EULA does not transfer any ownership rights to you.

Limitation of liability

To the maximum extent permitted by law, Finnwise will not be liable for indirect or consequential damages arising out of your use of the App. Finnwise does not guarantee the App will be error-free or uninterrupted.

Dispute resolution

Any dispute relating to this EULA or your use of the App will first be addressed through good-faith negotiations. If unresolved, it will be submitted to the competent courts in Mexico, unless mandatory law provides otherwise.
